Terms and Conditions

TRILOGY4 TERMS and CONDITIONS

These Terms of Service (“Terms”) govern your use of the Trilogy4 Web Services website (trilogy4.net), (trilogy4.com) and any web design, development, hosting, or related services we provide. By accessing our site or engaging our services, you agree to these Terms. Please read them carefully. If you do not agree, do not use our site or services.

We reserve the right to update these Terms at any time. Changes will be posted here with the updated date. Continued use after changes constitutes acceptance. These Terms work alongside our Privacy Policy.

Project Initiation and Payments

  • Work on custom projects begins upon receipt of the agreed deposit/startup fee.
  • Startup/deposit fees are non-refundable once work has commenced.
  • Project timelines are estimates only (typically 4–8 weeks depending on scope and client responsiveness) and subject to change. Delays in payments, content delivery, feedback, or additional requests can extend timelines.
  • Websites are made live upon final approval, completion of all payments, and satisfaction of any outstanding items.
  • For ongoing hosting/maintenance plans (if applicable): Monthly fees cover hosting, basic updates, and related services for the life of the website unless canceled per these Terms.
  • Flat-fee or one-time projects: Final balance is due upon completion. Hosting and domain renewal become the client’s responsibility thereafter unless other arrangements are made in writing.

Cancellation, Ownership, and Transfers

  • Monthly/ongoing clients: Provide at least 30 days’ written notice prior to the end of a paid cycle to cancel. Upon satisfying any remaining design/creative fees (established in writing at project start), we will transfer domain ownership and site files to you in an organized manner. The site may be removed from our hosting after the paid period ends if transfer is not completed.
  • Flat-fee clients: Balance due at project end. Domains and full access transfer once all design fees are paid.
  • All domains and hosting account access transfer to the client once web design fees are fully satisfied.
  • We retain the right to suspend or take down sites for non-payment after reasonable collection attempts.

Additional Services and Changes

  • Any additional services (beyond the original scope) are quoted separately and billed on a fee-for-service or hourly basis.
  • Revisions are included per the project agreement. Excessive changes or scope creep may incur additional fees.
  • Approved elements (design, content, etc.) are considered final. Further modifications will be invoiced accordingly.

Satisfaction and Scope

We are committed to client satisfaction within the agreed project scope. We work diligently to deliver high-quality custom CMS (Content Management System) sites, using various tools and programs. However:

  • “Satisfaction” is defined within the original agreement and our professional judgment of reasonable requests.
  • We cannot guarantee outcomes outside the agreed scope (e.g., additional services needed for full functionality).
  • We are not responsible for unreasonable expectations or requests beyond the signed proposal.

Client Responsibilities and Disclaimers

  • You are responsible for providing timely content, feedback, approvals, logos, images, and other materials in suitable formats (e.g., editable vector files for logos where possible; high-resolution photos).
  • If we must recreate non-editable assets (e.g., JPG/PNG logos), additional graphic design fees may apply.
  • We are not responsible for grammatical/spelling errors or inaccuracies in client-provided copy, or for the quality/content of client-supplied photos.
  • Websites may appear differently across devices, browsers, screen resolutions, and operating systems. We optimize for common modern setups but cannot guarantee identical appearance everywhere.
  • We do not assume liability for the content, products, or materials on your completed website. You are fully responsible for your site’s compliance with laws, accuracy, and any third-party elements.

Hosting, Domains, and Third-Party Services

  • Hosting and domain registration (where included) are subject to third-party provider terms. We use reliable partners but are not liable for their outages or policy changes.
  • Credit card and payment processing use secure third-party gateways. You are responsible for any transaction or monthly fees from those providers.
  • We take data security seriously but make no absolute guarantees against all breaches.

Intellectual Property and Site Content

  • We retain rights to our underlying processes, code frameworks, and designs until full payment. Upon payment, you receive a license to use the custom site.
  • All content on trilogy4.net is our property or properly licensed. You may not copy, reproduce, or reuse it without permission.
  • We are not liable for any information, products, or services found on client sites we design/host.

Payments and Late Accounts

  • Invoices are due as specified. Delinquent accounts may result in suspension of services after collection attempts.
  • A reinstatement fee may apply for reactivated services (amount determined at time of reinstatement).

General Disclaimers and Limitations

  • All prices on our site are subject to change and are for informational purposes. Final quotes are provided upon consultation.
  • Promotional offers are not cumulative unless stated.
  • Images on our site are representative only.
  • Our work is performed primarily from Texas (Houston area). We maintain the right to manage our team based on performance.
  • Limitation of Liability: To the fullest extent permitted by law, Trilogy4 Web Services shall not be liable for indirect, incidental, consequential, or punitive damages. Our total liability will not exceed the amount paid by you for the specific service in question.
  • No warranties beyond those explicitly stated in your project agreement. Services are provided “as is” except for the satisfaction commitment within scope.

Contracts

  • Written project agreements or proposals are required for new website design clients.
  • Monthly/ongoing clients remain under agreement until design fees are satisfied.
  • Advanced services (if offered) may have minimum terms.

Governing Law

These Terms are governed by the laws of the State of Texas. Any disputes shall be resolved in Harris County, Texas.
